NYPD Files Formal Charges Against Officer In Eric Garner Case

Eric Garner

The New York City Police Department has filed formal departmental charges against the officer who put Eric Garner in a chokehold when he resisted arrest for illegally selling individual cigarettes in 2014. Officer Daniel Pantaleo, was charged with violating department regulations for using a chokehold to subdue Garner. Sargent Kizzy Adonis was also charged for procedural infractions.

Pantaleo's case will be heard by the Civilian Complaint Review Board in early 2019 and he faces possible termination.

NYPD Deputy Commissioner Larry Byrne explained that the department waited over four years to file charges because they were waiting for the Department of Justice to act.

"The NYPD has come to the conclusion that given the extraordinary passage of time since the incident without a final decision on the U.S. DOJ's criminal investigation, any further delay in moving ahead with our own disciplinary proceedings can no longer be justified," he wrote in a letter after the charges were announced.
